Lending and Fixed Income Investing

SB&G represents lenders of all kinds in a wide range of corporate and commercial lending and investment transactions including acquisition lending, working capital loans, project finance, trade finance and asset securitizations. We regularly represent lenders in loan transactions secured by almost every type of collateral, and we also act for institutional and non-institutional lenders and investors in the private placement of debt and equity, and venture capital funding.

Restructuring, Creditor's Rights and Bankruptcy

SB&G has a significant creditors' rights and workout practice which is uniquely positioned to address the problems of creditors of financially distressed businesses. Our attorney's understanding of the mechanics, documentation, and legal basis of lending activities, and our attorney's thoughtful application of this understanding, is a key to our success in representing clients in workouts and liquidations. SB&G's experience with distressed companies greatly enhances our ability to represent lenders more effectively when a loan becomes troubled. We also represent creditors in chapters 7,11 and 13 bankruptcy proceedings.

Bank Deposits and Collections and Litigation

SB&G has a strong practice representing lenders in a variety of litigation matters. These cases have involved defending clients on improperly negotiated and forged instruments, lender liability claims, lien priority disputes, collection actions, fund availability and midnight deadline litigation, and TILA and consumer act violation claims.

In addition, our attorneys are on the leading edge of developing law. Laura Callan authored the brief in Pfister v. Milwaukee Economic Development Corporation, 216 Wis. 2d 243, 576 NW2d 554 (Ct. App. 1998), the case prompting major changes to Wisconsin’s wage claim lien law, and Kim Grimmer authored the prevailing brief in Production Credit Association v. Nowatztke, 90 Wis. 2d 344, 280 N.W.2d 118 (1979), one of the leading Wisconsin cases on conversion of collateral.
